Health Agreement
I hereby affirm that I am in good and stable mental and physical condition. I do not suffer from any mental or physical disability that would prevent or limit my participation in this retreat with Althea Lawton-Thompson of Aerobics, Yoga & More Fitness LLC, hereinafter referred to as ALT/AYM.
I understand ALT/AYM practices holistic healing techniques and various other healing modalities. I understand the intent of ALT/AYM is to offer information of a general nature to help in my quest for emotional, mental, physical and spiritual well-being. I understand ALT/AYM is not a licensed mental health therapist, doctor, nutritionist or registered dietitian. Statements, suggestions, recommendations, and protocols have not been evaluated or approved by the Food and Drug Administration or any licensing board. ALT/AYM does not provide medical aid, mental health guidance, or nutrition advice for the purpose of diagnosing, treating, curing, or preventing any illness or disease. I am ultimately responsible for all decisions pertaining to my health. I assume full responsibility for consulting a qualified health professional regarding health conditions or concerns. ALT/AYM is not responsible for adverse reactions, effects, or consequences resulting from the practices or use of any suggestions before, during or after my participation in this event.
I have been informed and understand that all information presented by ALT/AYM is intended for informational purposes only. I will not rely on this information as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. If I have any concerns or questions about my health, I will consult with a physician, licensed mental health professional, or other health-care professional.
I have made my own determination as to whether or not I am able to physically, emotionally, mentally, and psychologically safely participate in this session, and I have consulted professionals of my choosing to clear me in any necessary instance. I agree to assume all risks of using ALT/AYM‘s advice and suggestions, and hereby release and hold harmless Althea Lawton-Thompson, Aerobics, Yoga & More Fitness Studios LLC, their officers, agents, representatives, contractors, employees, and volunteers from any liability, and all health claims, suits, losses, or causes of action for damages, including claims for negligence, now or in the future, however caused, occurring during or after my participation in this retreat.
Room Assignment
I understand and agree that ALT/AYM is NOT responsible for providing a roommate for me. If I register as a Double, my roommate will register for the trip and pay in full at the same time as I do. If I register for a double and do not secure my own roommate, I may be assigned a roommate randomly. If no roommate is available, I will be responsible for paying the difference for a single room, or I forfeit all fees paid.
Trip Cancellation & Transferring Registration
In the case of natural disaster or international travel advisory causing cancellation of the retreat, the retreat will be rescheduled. If the retreat is not rescheduled, 75% of all fees paid will be refunded within 60 business days of cancellation. There will be no refunds if the trip is rescheduled within twelve (12) months from the original date.
I understand that my paid registration or partial registration may be transferred to a non-registered attendee. If I choose to cancel without transferring my registration, I understand that I forfeit all funds paid. I understand that I am responsible for paying the balance of my retreat, possibly at a higher price than the Full Payment, at least forty-five (45) days prior to the retreat start date to avoid forfeiture of my trip and all funds paid. I further understand and agree that if I do not pay the balance in full, I forfeit all fees paid unless I transfer my trip to a new registrant who completes the payment(s) in full.
International Travel
I understand that I am responsible for booking and paying for my travel to and from the city/state/province/country of this retreat.
I understand and agree that I must obtain a passport prior to departure. I agree that my passport will be valid for at least six (6) months after this trip ends. I will visit the U.S. Department of State at travel.state.gov for further information. I understand that if I am a non-US citizen, I will need to contact the embassy or consulate of this country to ensure I meet specific entry requirements.
I understand and acknowledge that may be traveling to a country other than my own and the customs and culture may be substantially different than the country of my origin. I understand that in this country, services in all aspects, including hotels, tours and restaurants, cannot be expected to be of the same standard as those in my home country.
Based on unknown and unpredictable factors, I understand there may be times when it becomes necessary to modify the retreat itinerary or cancel an outdoor excursion. In the event weather makes it impossible to travel between the airports or along the roads, I understand the itinerary may be altered.
Insurance
I understand that all activities and excursions led during this retreat carry inherent risks. I understand I may be visiting places where the geographical attributes present dangers and physical challenges that may challenge me physically and mentally. It is my responsibility to acquaint myself with all possible relevant travel information and weather advisories. I hold harmless ALT/AYM for any injuries that may incur on the properties or on an excursion during this retreat.
I understand and agree that it is my responsibility to ensure that I have adequate insurance and travel insurance coverage to cover risks such as medical costs, personal accident risks, personal liability, legal expenses, cancelled trip, missed flights, and lost luggage. I agree to insure my trip and will not seek any remedy from ALT/AYM for funds lost due to cancellation of the retreat.
Image Release
I hereby grant to ALT/AYM, all assigns, and those persons acting with ALT’s authority and permission, the right to take and create photographs/videos and other still and/or moving images, (in all formats) and other graphical depictions incorporating my likeness, in any and all media, whether now known or hereafter created (the “Content”).
I hereby agree that all rights in and to the Content, including the copyright, are and shall remain the sole property of ALT/AYM, free and clear from any claims by me or anyone acting on my behalf. ALT/AYM’s rights include, but are not limited to, the rights, in perpetuity, to: Use, re-use, publish, and re-publish the Content; Alter, modify or otherwise change the Content in any manner ALT/AYM desires; Combine the Content with textual matter and/or with other pictures and/ or media; and, Use the Content for illustration, promotion, art, editorial, advertising, trade, publishing, or any other purpose whatsoever. I hereby release, discharge, and agree to hold harmless ALT/AYM, their heirs, legal representatives and assigns, and all persons acting under ALT/AYM’s authority or those for whom they are acting, from any liability by virtue of any use of the Content or any changes or alterations made thereto.
Legal Agreement
The terms and provisions of these agreement supersede any other warranties, representations, terms or conditions, unless they are expressly stated within an addendum or in a letter signed by ALT/AYM. I have fully read and understand the effects of this informed consent, am fully aware of its terms and conditions and knowingly execute the same at my own free will and accord for the purposes and consideration set forth herein. I hereby warrant that I am of full legal age and have the right to contract in my own name. This waiver and release shall be binding upon me and my heirs, legal representatives and assigns.
I agree that any action, suit or proceeding relating to, arising out of or in connection with the terms, conditions and covenants of this Consent may be brought only in Gwinnett County in the state of Georgia in the United States of America. I hereby waive any objection to jurisdiction or venue in any proceeding filed within the above referenced county in relation to this Consent.
By participating in the event and by signing or checking (physically or electronically), I agree to the terms herein.
