Informed Consent & Waiver
I have made my own determination as to whether or not I am able to physically, emotionally, mentally, and psychologically safely participate in this workshop, and I have consulted professionals of my choosing to clear me in any necessary instance. I understand and agree that Althea Lawton-Thompson and Aerobics, Yoga & More Fitness Studios, LLC (hereinafter referred to as “ALT/AYM”) is not responsible for adverse reactions, effects, or consequences resulting from the practices or use of any practices demonstrated, suggested, recommended or taught in this workshop. I agree to assume all risks of using ALT/AYM’s advice, suggestions, recommendations, or instructional teaching and hereby release and hold harmless ALT/AYM, their officers, agents, representatives, employees, and volunteers from any liability, and all health claims, suits, losses, or causes of action for damages, including claims for negligence, now or in the future, however caused, occurring during or after my participation in this workshop.
I have been informed and understand that all information presented by ALT/AYM is intended for informational purposes only. I will not rely on this information as a substitute for, nor does it replace, professional certified or licensed medical, mental health, legal, finance or marketing advice. I understand ALT/AYM is NOT a medical professional, a licensed therapist, an attorney or CPA. Statements, suggestions, recommendations, and protocols have not been evaluated or approved by any licensing board. I will consult a certified or licensed professional before using any of the information mentioned, shared, or discussed during this workshop. I am ultimately responsible for all decisions pertaining to my health, mental wellness, or business. I assume full responsibility for consulting a qualified certified or licensed professional regarding my health, mental wellness, or business. ALT/AYM is not responsible for adverse reactions, effects, or consequences resulting from the practices or use of any suggestions during or after my participation in this workshop.
Electronic Sessions
Electronic sessions involve remotely using telecommunications technologies, such as video conferencing or telephone. Although there are benefits to electronic sessions, there are some risks as well. For example:
Risks to confidentiality. As electronic sessions take place outside of ALT/AYM’s office, there is potential for other people to overhear sessions if you are not in a private place during the session. I understand it is my responsibility to make sure I find a private place for my session where I will not be interrupted. It is also important for me to protect the privacy of my session on my cell phone or other device. I should participate in this workshop only while in a room or area where other people are not present and cannot overhear the conversation.
Issues related to technology. There are many ways that technology issues might impact an electronic session. For example, technology may stop working during a session, other people might be able to get access to our private conversation, or stored data could be accessed by unauthorized people or companies.
Electronic Communications
For communication between sessions, email communication and text messaging will be used with my permission. I am aware that ALT/AYM cannot guarantee the confidentiality of any information communicated by email or text. Therefore, they will only discuss any information by email or text if I request it.
Emergencies and Technology
I understand that ALT/AYM is not responsible for any technological problems over which they have no control. I further understand that I cannot guarantee that technology will be available or work as expected at all times. If the session is interrupted for any reason, I will disconnect from the session and reconnect to the same link. If I am unable to connect via the link within two (2) minutes, I will try to reconnect from another device.
Image Release
I hereby grant to ALT/AYM, all assigns, and those persons acting with ALT/AYM’s authority and permission, the right to take and create photographs/videos and other still and/or moving images, (in all formats) and other graphical depictions incorporating my likeness, in any and all media, whether now known or hereafter created (the “Content”).
I hereby agree that all rights in and to the Content, including the copyright, are and shall remain the sole property of ALT/AYM, free and clear from any claims by me or anyone acting on my behalf. ALT/AYM’s rights include, but are not limited to, the rights, in perpetuity, to: Use, re-use, publish, and re-publish the Content; Alter, modify or otherwise change the Content in any manner ALT/AYM desires; Combine the Content with textual matter and/or with other pictures and/ or media; and, Use the Content for illustration, promotion, art, editorial, advertising, trade, publishing, or any other purpose whatsoever. I hereby release, discharge, and agree to hold harmless ALT/AYM, their heirs, legal representatives and assigns, and all persons acting under ALT/AYM’s authority or those for whom they are acting, from any liability by virtue of any use of the Content or any changes or alterations made thereto.
Legal Agreement
This agreement is intended as a supplement to any other general informed consent that I may have agreed to at the outset of this workshop and does not amend any of the terms of that agreement. The terms and provisions of this agreement supersede any other warranties, representations, terms or conditions, unless they are expressly stated within an addendum or in a letter signed by ALT/AYM. I have fully read and understand the effects of this informed consent, am fully aware of its terms and conditions and knowingly execute the same at my own free will and accord for the purposes and consideration set forth herein. I hereby warrant that I am of full legal age and have the right to contract in my own name. This waiver and release shall be binding upon me and my heirs, legal representatives, and assigns.
I agree that any action, suit or proceeding relating to, arising out of or in connection with the terms, conditions and covenants of this Consent may be brought only in Gwinnett County in the state of Georgia in the United States of America. I hereby waive any objection to jurisdiction or venue in any proceeding filed within the above referenced county in relation to this Consent.
By participating in the event and by signing or checking (physically or electronically), I agree to the terms herein.
